A key aspect of this development is digital outsourcing, which offers inclusive opportunities for workers in developing countries, while simultaneously presenting significant challenges to the protection of workers' rights. This study seeks to examine the implications of digital outsourcing policies on worker protection within the context of labor law in Indonesia, highlighting both the positive and negative impacts, the increasing trends observed in Indonesia, and the associated regulatory challenges. The research employs a normative legal analysis, drawing on a statutory regulatory approach, complemented by a literature review of relevant prior studies. The findings reveal that digital outsourcing has positive effects, including expanded global job access, enhanced flexibility, and potential income growth. However, it also has negative consequences, such as legal status ambiguity, inadequate social protection, and excessive working hours. In Indonesia, outsourcing practices are grounded in Manpower Law and the Job Creation Law; however, regulations specifically addressing digital workers remain insufficiently comprehensive. Consequently, labor laws must be reinforced with targeted provisions responsive to digital work models, particularly with regard to the integration of personal data protection laws and cyber law. This research contributes to the ongoing discourse on the need to harmonize labor law with the evolving landscape of digitalization, ensuring equitable protection for workers engaged in digital outsourcing.</span></em></div> 2026-02-17T00:00:00+07:00 Copyright (c) 2026 Fadil Muhammad, Alfan Dzikria Nurrachman, Muhamad Sofian https://ejournal.umm.ac.id/index.php/ilrej/article/view/44194 Legal Protection Against The Impact of Geothermal Management on Communities: A Comparative Study in Kenya, Philippines and Indonesia 2026-03-02T23:20:58+07:00 Astrin Bernita Rahma [email protected] Ahmad Suryono [email protected] <div><em><span lang="IN">This study compares the regulatory frameworks in the Philippines, Indonesia, and Kenya to find out how they deal with the issue of legal protection for populations impacted by geothermal energy management. </span><span lang="EN-US">T</span><span lang="IN">o</span><span lang="EN-US"> protect</span><span lang="IN"> community rights during geothermal energy development, this study primarily aims to determine the conceptuali</span><span lang="EN-US">s</span><span lang="IN">ation, regulation, and implementation of public consultation. </span><span lang="EN-US">T</span><span lang="IN">he methodological references and respectable academic literature support the use of a qualitative legal research strategy with a regulatory analysis and comparative study technique</span> <span lang="IN">to ensure the</span><span lang="EN-US"> accuracy</span><span lang="IN"> of the analysis. While there is a very extensive legislative framework in place in Indonesia, the results demonstrate that public consultation is still not consistently carried out, particularly with regard to openness, community participation, and checks and balances. </span><span lang="EN-US">In t</span><span lang="IN">he</span><span lang="EN-US"> Philippines and Kenya,</span><span lang="IN"> accountability is greater, involvement methods are more inclusive, and procedural requirements are clearer. This research adds to the existing body of knowledge by identifying regulatory gaps in geothermal governance in Indonesia and providing examples of how other nations have strengthened public consultation duties</span><span lang="EN-US"> through</span><span lang="IN"> practices. This research identifies several regulatory and implementation gaps in Indonesia’s geothermal governance, particularly regarding transparency, accountability, and the effectiveness of public consultation mechanisms. Based on the comparative findings from Kenya and the Philippines, this study recommends strengthening Indonesia’s legal framework</span><span lang="EN-US"> by implementing</span><span lang="IN"> clearer procedural standards for public consultation, mandatory publication of consultation outcomes, enforceable government responses to public input, and the establishment of participatory monitoring mechanisms.
