Abstract

Misyar marriage is a form of marriage where the woman does not demand that
duly acquired rights in marriage, birth of a living. The woman has revoked his
right to a man who would marry her and the woman requires only a living mind
alone. Misyar marriage is usually applicable to women in high places or who has in
his possession a lot, but have not married because there is no man who would come
near the woman. Misyar marriage raises debate especially among contemporary
scholars. Because the new model known misyar marriage today, then the dissent of
contemporary scholars in determining the legal status. They are divided into two
groups, ie groups that allow and proscribe groups that misyar marriage. This
paper reveals the scholars of contemporary debates on the legal status of marriage.
