ABSTRACT
In Islam, the guardian of a Muslim is not allowed to marry with people who are not Muslim. In the event of marriage between a Muslim with a non-Muslim, it is clear that the marriage had violated the ban on religion. But the problems that researchers lift here, a woman married a man who is also a Moslem, then the husband was an apostate from the religion.
This research is a research library which is intended to analyze the legal consequences of a husband murtadnya against marital status and the status of the child's relationship after the apostasy.
The study found that (1) marriage is still valid, if still bring maslahat for wives, husbands, children and their large family. If the marriage was no longer bring maslahat, let alone bring harm, then the marriage should be canceled. (2) if the marriage can be maintained, then the children born of the relationship after murtadnya husband is the children who are legally as a child who has been apostate husband. However, if the marriage has been legally terminated, then the children born as a result of the relationship after murtadnya husband can not be called legitimate children.
