ABSTRACT

 

The trend apparent in recent years is the emergence of attitudes haste and carelessness by the people as well as certain institutions in giving fatwas. Such a situation is very worrying because most of the issues they raised pertained risky. They are very easy to determine the position of "halal" or "haram" to something, when in fact they do not pay attention to ethics in giving fatwa and have no qualifications or authority as a mufti (experts fatwa).

This trend is something that must be straightened. Fatwas as a method in the Qur'an and Sunnah to explain Syari’ah law, can not be done by the person or entity which has no religious authority. So also a mufti must pay attention to ethics and the requirements as a mujtahid. Because, if not so, he would easily slip in error.

This paper, discusses clearly how the position of the fatwa in Islam and in human life, academic requirements and scientific ethics for a mufti.
