Study of Muqaran al-Baqarah Verse 180 and Hadith of the Prophet No Will for Heirs

Abstract

According to the jurists, a will is a grant of property rights that takes place after the testator dies. In this article, the will will be studied with the study of muqaran, which is the interpretation of QS. Al-Baqarah verse 180 and the Prophet's Hadith there is no will for heirs. A majority of scholars are of the opinion that the testament verse in QS. Al-Baqarah verse 180 has been deleted by the heirs' verses on the grounds that the Prophet's hadith that there is no will for the heirs has been well received by Islamic scholars. There are two opinions related to this: The first opinion says that there is no obligatory will. The second opinion is that what is erased is only a will to the next of kin of the heir. According to Abu Muslim al-Asfahani and Ibn Jarir al-T{abari that the verse of will in al-Baqarah verse 180 is not erased by the verses of mawaris with the reason: There is no contradiction between the verse of will and the verses of mawaris; If there is a conflict, then it can be compromised.
